Property
We are buying, selling or dividing a property.
Money and ownership do not move at the same moment. The buyer becomes the owner only when the land registry records the transfer, so the contract and the escrow of the price must make sure nobody pays for something they do not receive.
What needs to be settled
- Who receives the money and when: escrow with a lawyer, a notary or a bank, and the conditions for releasing it
- What the land register shows: mortgages, easements, rights of first refusal
- When dividing: an agreement between co-owners or an application to the court, and how a share is valued
- In Slovakia co-owners have a statutory right of first refusal (except on a transfer to a close person); in the Czech Republic only in some cases, for example where the co-ownership arose by inheritance
What we do
- We check the land register entry, any encumbrances and the other party
- We draft or review the purchase contract and the escrow agreement
- We file the application with the land registry and follow it until the transfer is recorded
- When dividing, we propose an agreement; if it fails, we represent you in court
Price: Hourly with a cap you approve in advance: in a purchase or sale nobody knows beforehand how the negotiations will go. We propose the model in writing after the first consultation. What it costs →
